Purpose:

To waive a breach of the terms of the lease of the South East Area dated 26 March 1997 (surrendered and regranted 26th November 1998) to allow Gloucestershire Airport Ltd, the tenant, to grant a supplemental lease at a peppercorn rent of a small area of land adjacent to Unit 32-33 Babcock Mission Critical Services Onshore Ltd and also to grant a car parking licence to the same subtenant on land adjacent to unit SE34. Details of the waiver and underletting and licence are contained on the attached letter dated 12 February 2019.

Decision:

To waive a breach of the terms of the lease of the South East Area dated 26 March 1997 (surrendered and regranted 26th November 1998) to allow Gloucestershire Airport Ltd, the tenant, to grant a supplemental lease at a peppercorn rent of a small area of land adjacent to Unit 32-33 Babcock Mission Critical Services Onshore Ltd and also to grant a car parking licence to the same subtenant on land adjacent to unit SE34. Reasons for the decision:

To allow our Tenant Gloucester Airports Ltd to act commercially and document a subtenants occupation of land in the South East Area.  The licence will degenerate income for the Landlord and Tenant and any rental value in the additional land will be reflected in the rent paid by the subtenant on the main lease.

Alternative options considered:

To refuse to consent but this would prevent the letting and fetter commercial activity which ultimately the Council will benefit from.
