Purpose:

That the Policy and Governance Manager be appointed as the Council’s Deputy Electoral Registration Officer to perform and exercise the duties and powers of the Electoral Registration Officer when required.

That the Policy and Governance Manager be appointed as the Council’s Deputy Electoral Registration Officer to perform and exercise the duties and powers of the Electoral Registration Officer when required.

Reasons for the decision:

Under Section 8(2) of the Representation of the People Act 1983, the Council must appoint a senior officer to the position of ERO. This position is responsible for maintaining and publishing the register of electors for the area. The Managing Director is the appointed ERO for Gloucester City Council. Under Section 52(2) of the Representation of the People Act 1983, the Council may approve the appointment of Deputy EROs to perform and exercise any of the duties and powers of the ERO and in Gloucester the authority to appoint such deputies has already been delegated to ERO.

Following changes introduced by the Elections Act 2022 in respect of the issuing of temporary voter authority certificates (VAC), and in accordance with Electoral Commission guidance, it is proposed that the ERO delegates their powers and duties to ensure that if it became necessary to sign a temporary voter authority certificate, it could be dealt with efficiently and effectively without unreasonable delay. The Deputy ERO would also be able to conduct a registration hearings, following a registration review and an objection to the removal of an elector from the register of electors.

The Policy and Governance Manager is the Service Manager for electoral services functions, therefore it is appropriate for the appointment to be attached to this existing post.

Alternative options considered:

The Council could decide not to appoint a Deputy ERO. This would mean that the ERO would have to physically sign any temporary VACs and conduct registration hearings themselves and is therefore not recommended.
