Before the application was debated, the Chair drew Members’ attention to an inaccuracy in the report which referred to the premises as 126 Eastgate Street.  This should have read ‘136’ Eastgate Street.  This was noted by the Committee.

 

The Chair confirmed that those Members present had read the report fully before attending the meeting.

 

The application before Members was from Gloucestershire Constabulary for a review of a premises licence made under Section 51 of the Licensing Act 2003 in respect of the Best Takeaway, a hot food unit situated at 136 Eastgate Street, Gloucester. 

 

Committee was advised that an agreement had been made by both parties to append the following conditions to the licence:-

 

  • The CCTV system shall be maintained in good working order, it shall record at all times when the premises are open and recordings shall be kept for a minimum of 28 days (14 days for digital systems ) and be provided to Officers of the Council and Police on request. The CCTV system should cover all areas where the public have access and service areas. External cameras should be utilised at the front and rear of the premises. The system shall include an audio recording facility and signage should be displayed informing customers of this.

 

  • A dedicated SIA door supervisor shall be employed at the premises on a Saturday and Sunday morning from 01.00 until closure as well as Bank Holiday weekends including Bank Holiday Mondays, New Years Eve, Christmas Eve and Halloween. They shall be clearly identifiable as security wearing a high visibility jacket. The SIA door supervisor shall ensure the dispersal of groups congregating with food outside the venue, along with facilitating clear entry and egress from the premises.

 

In view of this agreement, neither party had attended the Hearing and had notified the Council in advance that this would be the case.

 

The Committee discussed the following points:-

 

·         Concern was expressed at the way the application had been reported in the local newspaper.

·         The CCTV system and doorman as required in the appended conditions to the licence were already in place.

·         Members felt that good liaison between the licence holder and the Police should be encouraged.

·         Police liaison with the Council’s Licensing Officers had improved.

 

RESOLVED

 

That the modifications to the premises licence in line with the agreement between Gloucestershire Constabulary (the Applicant) and Mr Hasan Gligil (the Premises Licence Holder) be approved and that Officers be authorised to issue a revised premises licence to include the agreed conditions.
